We use cookies and similar technologies to operate the Website and, subject to your choices, to analyse usage and support marketing activity.
Non‑essential cookies, including analytics and marketing cookies, are used only where you have provided consent through our cookie banner or settings.

We use HubSpot to support website forms, customer relationship management, and, where enabled by your preferences, analytics and marketing functions. Details of how cookies and personal data are used are explained in our Privacy Policy and Cookie Policy.

9. Data protection

We process personal data in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.

In most cases, for personal data collected through the Website (for example via enquiries, newsletter sign‑ups, booking requests, or form submissions), we act as a Data Controller.

Where we provide services to clients and process personal data on their behalf, we may act as a Data Processor. In those circumstances, processing will be governed by the relevant service contract and a Data Processing Agreement (where applicable).

Some of our suppliers, including HubSpot, may process personal data outside the UK. Where this happens, we take steps to ensure appropriate safeguards are in place, as described in our Privacy Policy.

Full details about how we collect, use, share, and retain personal data (including lawful bases and how to exercise rights) are in our Privacy Policy: https://www.thedataframe.co.uk/privacy-policy.

10. Your rights

Under UK GDPR, you have rights in relation to your personal data. These rights are not absolute and may apply only in certain circumstances.

You can ask us to:

  • provide a copy of the personal data we hold about you (access);

  • correct inaccurate or incomplete personal data (rectification);

  • delete your personal data where we no longer need it or where the law allows (erasure);

  • restrict how we use your personal data in certain situations (restriction);

  • provide your personal data to you or another provider in a usable format, where applicable (data portability);

  • stop or limit processing in certain circumstances, including direct marketing (objection);

  • and, where applicable, not be subject to a decision based solely on automated processing, including profiling.

To make a request, email hello@thedataframe.co.uk with enough information for us to identify you and locate the relevant data. We may need to verify your identity before responding.

We aim to respond without undue delay and within one month. In some cases, we may extend the timeframe where permitted by law (for example, if a request is complex or we receive multiple requests). If we cannot comply with a request, we will explain why.

You also have the right to raise a concern with the UK Information Commissioner’s Office (ICO).

11. Right to be forgotten

If you ask us to delete your personal data, we will assess your request and, where the right to erasure applies, remove or anonymise relevant personal data from our systems (including, where applicable, our CRM platform such as HubSpot).

The right to erasure is not absolute, so we may need to retain some information where required by law or where we have a lawful reason to do so (for example, for contractual, legal, or compliance purposes).

We aim to respond within one month and will confirm the outcome or explain any lawful reason we cannot fully delete the data.

12. Communications and marketing

If you provide your contact details, we may contact you in relation to your enquiry, booking, request, or other relevant operational matters.

We will send marketing communications only where permitted by law and, where required, with your consent. You can opt out at any time using the unsubscribe link in any marketing email or by contacting us at hello@thedataframe.co.uk.

We are committed to making our Website as accessible and inclusive as possible.

You must not attempt to bypass security controls or interfere with the Website’s operation.

15. Liability (Website use)

Nothing in these Terms limits or excludes liability that cannot be limited or excluded by law, including liability for death or personal injury caused by negligence, fraud, or fraudulent misrepresentation.

Subject to the above, we are not liable for losses arising from your use of, or inability to use, the Website where such losses were not reasonably foreseeable at the time of use.

We are not liable for indirect or consequential losses, including loss of profits, revenue, business opportunity, goodwill, anticipated savings, or business interruption.

The Website and its content are provided “as is” and “as available”. We do not guarantee the Website will be uninterrupted, error‑free, or free from bugs or vulnerabilities.

16. Freedom of Information

What this means

Some organisations we work with are part of the UK public sector, such as local authorities, NHS bodies, government departments, or publicly funded organisations. These organisations are subject to the Freedom of Information Act 2000, which means they may be legally required to share certain information they hold if a member of the public makes a valid request.

In some cases, this information may relate to suppliers or services provided under a contract. The public authority is responsible for deciding what information must be disclosed and what can lawfully be withheld, for example where disclosure would involve personal data or commercially sensitive information.

Freedom of Information

Where we provide services to UK public sector organisations, those organisations may be required to comply with the Freedom of Information Act 2000 and related transparency obligations.

This means that information about a contract or the delivery of services, including information provided by us to the public authority, may be requested by the public. The public authority is responsible for handling any such request and for deciding what information it is required to disclose and what it may lawfully withhold.

Nothing in these Terms prevents a public authority from disclosing information where it is required to do so by law or from meeting its legal obligations relating to transparency and access to information. Where appropriate, we may support our public sector customers by providing relevant information to help them respond to such requests.

17. Changes to these Terms

We may update these Terms from time to time. Any changes will be posted on this page with an updated “Last updated” date. Continued use of the Website means you accept the revised Terms.

18. Governing law and jurisdiction

These Terms (and any dispute or claim arising out of or in connection with them) are governed by the law of England and Wales.
The courts of England and Wales will have exclusive jurisdiction, subject to any consumer rights that cannot be excluded under applicable law.

19. Approval and signature

These Website Terms and Conditions have been reviewed and approved by the Board of Directors of DataFrame Solutions Ltd.
